\u00ab\u00a0The congressional debates on the Civil Rights Act of 1866 and the Fourteenth Amendment document the union of exclusion and equality within the liberal order. The Act was intended to clarify the status of the freed and protect the forms of personal liberty regularly violated by the Black Codes and social custom. The Act declared that all persons \u201cshall have the same right in every State and Territory of the United States to make and enforce contracts, to sue, to be parties and give evidence, to inherit, purchase, lease, sell, hold, and convey real and personal property, and to full and equal benefit of all laws and proceedings for the security of person and property, as is enjoyed by white citizens.\u201d Of particular importance in the congressional debate on the Civil Rights Act and Fourteenth Amendment is the extent to which this new equality of rights depended upon the transformation of former slaves into responsible and reasonable men. The norms at issue were masculinity, rationality, industry and restraint, and they determined one\u2019s ability to handle the duties and privileges of the citizen-subject and participate in the body politic. Ostensibly at stake in the question of manhood were the criteria for citizenship, yet it was apparent that espousals of responsible manhood and equality invariably aroused anxieties about the commingling of the races. In light of such fears, responsible manhood accrued undue gravity.\u00a0\u00bb<\/p>\n
